This program equips public defenders, civil legal aid attorneys, and legal services decision makers with practical strategies for navigating the ethical considerations involved in using AI-powered tools in client-centered legal practice.  

Participants will learn how to:

  • Identify key ethical questions to ensure compliance with the ABA Model Rules of Professional Conduct and relevant Formal Opinions when adopting AI tools—particularly with respect to protecting client confidentiality and the attorney–client privilege (Rules 1.1, 1.4, 1.6, 1.7, and 5.3; ABA Formal Opinions 477R, 498, and 512)
  • Assess and mitigate vendor-related risks through informed vetting of technology partners, including review of data practices, security safeguards, and access controls
  • Examine critical considerations related to automated analysis, potential conflicts of interest, data breaches, and the management of sensitive client information across both criminal and civil practice settings
  • Understand how a vendor’s broader business relationships and user base can raise ethical considerations, particularly for attorneys committed to confidentiality, independence, and client-aligned advocacy
